Käyttämällä Birkku-sovellusta hyväksyt nämä ehdot. Jos et hyväksy ehtoja, älä käytä palvelua.
1. Palvelu
Birkku on golfin tulosten, tilastojen ja kaveritoimintojen seurantaan tarkoitettu sovellus. Kehitämme palvelua jatkuvasti ja voimme muuttaa tai lopettaa yksittäisiä toimintoja.
2. Maksuttomuus
Sovellus on käytettävissä maksutta. Jos otamme myöhemmin käyttöön maksullisia lisäpalveluja, niistä kerrotaan selkeästi etukäteen eikä niitä veloiteta ilman erillistä hyväksyntääsi.
3. Tili
Vastaat antamiesi tietojen oikeellisuudesta ja tunnustesi salassapidosta sekä kaikesta tililläsi tapahtuvasta toiminnasta. Tili on henkilökohtainen. Palvelun käyttäjän tulee olla vähintään 13-vuotias.
4. Sallittu käyttö
Palvelua käytettäessä on kiellettyä:
- rikkoa lakia tai kolmannen osapuolen oikeuksia,
- lähettää loukkaavaa, häiritsevää tai laitonta sisältöä,
- häiritä palvelun toimintaa, murtautua siihen tai kerätä tietoja automaattisesti,
- esiintyä toisena henkilönä tai käyttää toisen tiliä.
Voimme poistaa sääntöjä rikkovan sisällön tai sulkea tilin.
5. Käyttäjän sisältö
Omistat lisäämäsi sisällön, kuten kierrostiedot ja kommentit. Annat meille rajoitetun oikeuden tallentaa ja näyttää sisältöä palvelun toteuttamiseksi (esimerkiksi näyttää kierroksen siihen osallistuneille pelaajille). Oikeus päättyy, kun poistat sisällön tai tilisi.
6. Immateriaalioikeudet
Sovellus, sen ohjelmisto, tavaramerkit ja ulkoasu ovat meidän omaisuuttamme. Sinulle myönnetään henkilökohtainen, ei-yksinomainen ja peruutettavissa oleva oikeus käyttää sovellusta näiden ehtojen mukaisesti.
7. Ei takuuta
Palvelu tarjotaan ”sellaisena kuin se on”. Emme takaa, että palvelu on keskeytyksetön, virheetön tai että tulokset, tilastot tai etäisyydet ovat aina tarkkoja. Älä käytä etäisyystietoja kilpailun sääntöjen vastaisesti.
8. Vastuunrajoitus
Emme vastaa välillisistä tai epäsuorista vahingoista, kuten tietojen menetyksestä tai saamatta jääneestä hyödystä, siinä laajuudessa kuin pakottava laki sallii. Mikään näissä ehdoissa ei rajoita vastuutamme tahallisuuden tai törkeän huolimattomuuden osalta.
9. Tilin päättäminen
Voit lopettaa palvelun käytön ja poistaa tilisi milloin tahansa sovelluksesta. Voimme sulkea tilin, jos rikot näitä ehtoja tai jos palvelun tarjoaminen lopetetaan.
10. Apple
Nämä ehdot solmitaan sinun ja The Birdie Company Oy:n välillä, ei Applen kanssa. Apple ei ole vastuussa sovelluksesta eikä sen sisällöstä, ylläpidosta, tuesta tai mahdollisista vaatimuksista. Apple ja sen tytäryhtiöt ovat näiden ehtojen kolmansia edunsaajia ja voivat vedota niihin. Sitoudut noudattamaan sovellettavia App Storen käyttöehtoja.
11. Muutokset ja sovellettava laki
Voimme päivittää näitä ehtoja; merkittävistä muutoksista ilmoitamme sovelluksessa. Ehtoihin sovelletaan Suomen lakia, ja riidat ratkaistaan ensisijaisesti neuvottelemalla. Kuluttajalla on aina oikeus saattaa asia kuluttajariitalautakunnan käsiteltäväksi.

By using the Birkku app you accept these terms. If you do not accept them, do not use the service. The service is provided by The Birdie Company Oy (Finland).
1. The service
Birkku is an app for tracking golf scores, statistics and friend activity. We develop the service continuously and may change or discontinue individual features.
2. Free of charge
The app is free to use. If we later introduce paid features, we will clearly announce them in advance and never charge you without your separate approval.
3. Account
You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity on your account. Accounts are personal. Users must be at least 13 years old.
4. Acceptable use
When using the service it is prohibited to:
- break the law or infringe third-party rights,
- post offensive, harassing or illegal content,
- disrupt or attack the service, or scrape data automatically,
- impersonate another person or use someone else's account.
We may remove violating content or close an account.
5. Your content
You own the content you add, such as round data and comments. You grant us a limited right to store and display that content in order to operate the service (for example, showing a round to the players who took part). The right ends when you delete the content or your account.
6. Intellectual property
The app, its software, trademarks and design are our property. You receive a personal, non-exclusive, revocable right to use the app in accordance with these terms.
7. No warranty
The service is provided "as is". We do not warrant that it is uninterrupted or error-free, or that scores, statistics or distances are always accurate. Do not use distance information in breach of competition rules.
8. Limitation of liability
To the extent permitted by mandatory law, we are not liable for indirect or consequential damages such as loss of data or lost profits. Nothing in these terms limits our liability for intent or gross negligence.
9. Termination
You may stop using the service and delete your account at any time in the app. We may close an account if you breach these terms or if the service is discontinued.
10. Apple
These terms are concluded between you and The Birdie Company Oy, not with Apple. Apple is not responsible for the app or its content, maintenance, support, or any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You agree to comply with the applicable App Store Terms of Service.
11. Changes and governing law
We may update these terms; we announce material changes in the app. These terms are governed by the laws of Finland, and disputes are primarily resolved through negotiation. Consumers always have the right to refer a matter to the Finnish Consumer Disputes Board.
